These terms explain who we are, how we provide your chiropractic care, and the rules for using our website. Please read them carefully — by booking an appointment, receiving our Services, or using this website, you agree to them.

About us and your care

1. About us and these terms

1.1

This website at www.chiropractor-new-milton.co.uk and the chiropractic services provided at our clinic are operated by BritChiro New Milton Ltd (“BritChiro New Milton”, “we”, “us” or “our”), a private company limited by shares registered in England and Wales (company number 08371100), with registered office at Suite 9, Pine Court Business Centre, 36 Gervis Road, Bournemouth, BH1 3DH. Our clinic is at 27 Old Milton Road, New Milton, Hampshire, BH25 6DY.

1.3

These Terms & Conditions (“Terms”) apply to: (a) your use of our website; and (b) the chiropractic and related services we provide to you (the “Services”). Please read them carefully. By using our website, booking an appointment, or receiving our Services, you agree to these Terms.

1.4

We may amend these Terms from time to time (see clause 23). The version published on our website at the time you book or use our Services is the version that applies.

1.5

Nothing in these Terms affects your statutory rights as a consumer.

2. Our regulated status

2.1

Chiropractic is a statutorily regulated healthcare profession in the United Kingdom. The chiropractors at BritChiro New Milton are registered with, and regulated by, the General Chiropractic Council (the “GCC”), the UK statutory regulator of chiropractors.

2.2

We are also members of the United Chiropractic Association (the “UCA”).

2.3

Our chiropractors are primary healthcare practitioners. You do not need a referral from your GP to consult us.

3. Booking appointments

3.1

You can book by calling us on 01425 62 88 44 or by submitting your details through the enquiry form on our website. If you contact us through the form, you agree that we may contact you about your enquiry.

3.2

Same-day and walk-in appointments are often available, but we cannot guarantee availability. The quickest way to be seen is to telephone the clinic.

3.3

An enquiry submitted through our website is a request for us to contact you and does not by itself create a confirmed booking. We aim to respond the same working day. Your appointment is confirmed once we have agreed a date and time with you, usually by telephone.

3.4

You may be required to pay a holding fee to secure a new-patient (initial consultation) appointment, owing to the amount of time we set aside for it. We will tell you whether a holding fee applies, and how much it is, when you book.

4. Your first visit and Report of Findings

4.1

Your first visit is an initial consultation and examination lasting approximately 40–60 minutes. It is a full diagnostic assessment of your health as it relates to chiropractic care.

4.2

Following your examination, your chiropractor will explain their findings in a “Report of Findings”, including your diagnosis (where one can be made), your options, and an estimate of the likely course of care.

4.3

You are under no obligation to commit to any course of treatment. Any decision to proceed is yours.

4.4

Because the first visit is a full diagnostic assessment, the first-visit fee is payable regardless of the outcome — including where we conclude that chiropractic care is not suitable for you (see clause 9).

5. Consent to examination and treatment

5.1

We will not examine or treat you without your informed consent. Before treatment begins, your chiropractor will explain what is proposed, the nature of the treatment, and any material risks, and will answer your questions.

5.2

You may ask questions, request a chaperone, or withdraw your consent at any time.

5.3

Chiropractic treatment involves the manual adjustment of joints. While treatment is generally well tolerated, as with any healthcare intervention there are potential risks, which your chiropractor will discuss with you so that you can make an informed decision.

5.4

It is important that you give us accurate and complete information about your health, symptoms, medical history and any medication, and that you tell us about any change in your condition, so that we can care for you safely.

6. X-Rays and ionising radiation

6.1

An on-site digital X-Ray is available where it is clinically justified. Your chiropractor will discuss any proposed X-Ray with you before it is taken.

6.2

X-Ray examinations are carried out in accordance with the applicable ionising radiation regulations, and only where the clinical benefit justifies the exposure.

6.3

X-Rays are charged separately from the first-visit fee. Our current charges can be found on the Fees page of our website (see clause 7).

7. Fees and payment

7.1

Our current fees are clearly stated on the Fees page of our website.

7.2

Our Services are exempt from VAT, as healthcare provided by a registered health professional.

7.3

We operate on a pay-as-you-go basis. You pay for each visit at the end of that visit. We do not sell prepaid packages and we do not require payment in advance for a block of treatment.

7.4

We accept payment by Visa or Mastercard (credit or debit) and by cash.

7.5

We may change our fees from time to time. The fees that apply are those in force at the time of your visit, which we make available at the clinic and on our website. We will tell you the cost of any X-Ray before it is taken.

8. Private health insurance

8.1

The chiropractors at BritChiro New Milton are recognised by most major UK health insurers, including AXA, Cigna, Simply Health and Vitality. Recognition and the level of cover vary between insurers and policies, so please check your policy.

8.2

Please tell us which private health insurer you hold when you book, as charges may differ for insured patients.

8.3

Unless we expressly agree otherwise, you are responsible for paying our fees at the time of your visit and then claiming reimbursement from your insurer. You remain liable for any amount your insurer does not cover.

9. If we cannot help you

9.1

At your first visit (or later) we may conclude that chiropractic care is not suitable for you. If so, we will tell you honestly and, where appropriate, refer you to your GP or another specialist. We may offer to provide a short report to support your onward care.

9.2

As set out in clause 4.4, the first-visit fee remains payable in these circumstances, because it covers a full diagnostic assessment.

10. Cancellations and missed appointments

10.1

If you need to cancel or rearrange an appointment, please give us as much notice as possible so that we can offer the appointment to another patient who needs it.

10.2

A cancellation fee applies to appointments that are not cancelled more than 24 hours in advance, and to missed appointments. As a gesture of goodwill, we will generally waive this fee on the first occasion. Our current cancellation fee is the price of one treatment session.

10.3

We will tell you about any cancellation fee that applies, and how to pay it, before your next appointment.

11. Children and patients who need support

11.1

We welcome patients of all ages, including babies and children. Where a patient is under 18, a parent or other person with parental responsibility must consent to the examination and treatment and, where appropriate, accompany the patient.

11.2

If you need any additional support to attend or to communicate with us, please let us know when you book and we will do our best to assist.

12. Your responsibilities

12.1

You agree to: (a) provide accurate and complete information about your health and history; (b) tell us about any changes in your health or medication; (c) follow the advice and any home-care recommendations given by your chiropractor, to the extent you are comfortable doing so; and (d) treat our staff with courtesy.

13. Complaints

13.1

We aim to provide a high standard of care. If you are unhappy with any aspect of your care or our service, please tell us as soon as possible by contacting the clinic on 01425 62 88 44 or at britchironewmilton@gmail.com, so that we can try to put things right.

13.2

We will acknowledge your complaint and respond in accordance with our in-clinic complaints procedure, a copy of which is available on request.

13.3

You also have the right to raise concerns with the General Chiropractic Council, the statutory regulator of chiropractors (www.gcc-uk.org), if the in-clinic complaints procedure has not been able to resolve your complaint.

14. Your clinical records, privacy and confidentiality

14.1

We keep clinical records about your care, and we treat your personal and health information as confidential, in accordance with our professional obligations and applicable data protection law (including the UK GDPR and the Data Protection Act 2018). We are registered with the Information Commissioner’s Office (ICO registration number ZA174267).

14.2

Our Privacy & Cookies Policy explains what personal data we collect, how we use it, the lawful bases on which we rely, how long we keep it, and your rights. It forms part of these Terms.

15. Using our website

15.1

You may use our website for lawful purposes only, and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the website by, anyone else.

15.2

You must not misuse our website by knowingly introducing viruses or other harmful material, or by attempting to gain unauthorised access to the website or the server on which it is stored.

16. Information on our website is not medical advice

16.1

The content on our website is provided for general information only. It is not medical advice and is not a substitute for an individual consultation, examination, diagnosis or treatment by a qualified healthcare professional.

16.2

You should not rely on the information on our website as an alternative to professional healthcare. If you have any concern about your health, please contact us or your GP. If you think you may be experiencing a medical emergency, call 999 or seek urgent medical help.

16.3

While we take reasonable care to ensure the information on our website is accurate and up to date, we make no warranty or guarantee that it is complete, current or error-free.

17. Reviews and testimonials

17.1

Any patient reviews, testimonials or outcomes shown on our website reflect the experiences and opinions of individual patients. Chiropractic care is tailored to the individual, and results vary from person to person. Testimonials are not a promise or guarantee that you will achieve the same results.

18. Intellectual property

18.1

Unless otherwise stated, we (or our licensors) own the copyright, trade marks and all other intellectual property rights in our website and its content, including text, images, logos and video.

18.2

You may view, download and print pages from our website for your own personal, non-commercial use. You must not otherwise copy, reproduce, republish or exploit any content without our prior written permission.

19. Links to other websites

19.1

Our website may contain links to third-party websites and resources (for example Google Maps, the General Chiropractic Council, the United Chiropractic Association and health insurers). These links are provided for your convenience only.

19.2

We have no control over, and accept no responsibility for, the content, availability or privacy practices of third-party websites. A link does not imply our endorsement.

20. Availability of our website

20.1

We do not guarantee that our website, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict all or part of our website for business or operational reasons, and will try to give reasonable notice of any suspension.

21. Our responsibility for loss or damage

21.1

We will provide our Services with reasonable care and skill, as required by the Consumer Rights Act 2015.

21.2

Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded by law. Your statutory rights as a consumer are not affected by these Terms.

21.3

Subject to clause 21.2, we are not liable for any loss or damage that was not reasonably foreseeable, or for business losses, as our Services are supplied to you as a consumer for personal use.

21.4

Subject to clause 21.2, our total liability to you, whether arising from your use of our website or from the Services we provide, is limited to the extent permitted by law and will not exceed the total fees you have paid to us for the services to which the claim relates.

22. Events outside our control

22.1

We are not responsible for any failure or delay in performing our obligations where that failure or delay is caused by events outside our reasonable control (for example, severe weather, illness, or power or equipment failure). If such an event occurs, we will contact you as soon as reasonably possible to rearrange your appointment.

23. Changes to these terms

23.1

We may update these Terms from time to time, for example to reflect changes in our Services, our fees, or the law. The current version is always available on our website, with the “last updated” date shown at the top.

24. General

24.1

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

24.2

If we do not insist that you perform any of your obligations, or if we delay in enforcing our rights, that will not mean that we have waived our rights against you.

24.3

These Terms are between you and us. No other person has any right to enforce them.

25. Governing law and jurisdiction

25.1

These Terms, and any dispute or claim arising out of or in connection with them or the Services, are governed by the law of England and Wales. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction, although if you live in another part of the United Kingdom you may also bring proceedings in that part.
